Eye Of Newt of the Day: Rude Music Inc, a company owned by founding Survivor member Frank M. Sullivan III, has filed a lawsuit against Newt Gingrich, seeking to bar the presidential candidate from using the band’s biggest hit, “Eye of the Tiger,” at campaign rallies, as well as damages for past instances in which he used the iconic Rocky III theme song.
The lawsuit claims Gingrich has used the song as his entrance music since at least 2009.
“Mr. Gingrich’s and Newt 2012, Inc.’s infringement of “Eye of the Tiger” is willful,” alleges the company [pdf]. “Mr. Gingrich is sophisticated and knowledgeable concerning the copyright laws, both as a private individual and business owner, and as a former elected official.”
Rude Music is seeking damages “in an amount to be determined by the Court.”
Meanwhile, Mitt Romney doesn’t need to rely on a recording of a copyrighted song to make an entrance. “America the Beautiful” and his own dulcet voice are all he needs to get the crowd pumped:
